Facilitative Mediation
There are different types of mediation. Understanding what is best for you is key. Flo uses facilitative mediation.
Facilitative mediation uses a process called ‘principled negotiation’ which enables participants to own the problem and work towards a resolution.
This approach separates people from the problems focusing on satisfying mutual needs, interests and concerns rather than their positions.
Facilitative mediation is confidential, without prejudice, cost effective and prevents the relationships from degenerating.
Facilitative mediation works on the basis that the mediator’s opinions, advice, and evaluation are not brought into a mediation. The role of a mediator:
Seeks to draw out options from the participants themselves, even if they seem unlikely, so encouraging a range of options to be explored
Aims to provide a fair, open and balanced environment by being a neutral third participant, organically cultivating a flow of conversation as a independent listener
Ensures the pace is driven by the participants so they feel at ease
Enables the flow of organic conversation and dialogue by allowing each participant to share, in both open and private sessions
Creates an environment of trust and confidence in the process enabling financial, mental and emotional benefits for all participants
Helps the participants explore possibilities, deliberate and concentrate on reasonable options with a view to agree and finalise the settlement agreement
In summary, in facilitative mediation, the mediator is responsible for the process whilst the participants are in charge of the outcome.
Flo Seven Step Process

Pre-Mediation – Contact us to talk through the process, what your needs are and to ascertain if this process is the best for you.

Pre-Mediation – We will arrange when and where to meet, online, in-person or both.

During Mediation – We will set out the expectations to the participants and deal with the administrative issues including signing the mediation agreement before commencing.

During Mediation – The participants will be invited in turn to summarise what they hope to achieve from the mediation.

During Mediation – We will seek to facilitate a discussion and constructive negotiation between the participants and ascertain if there is common ground and what alternatives are possible.

During Mediation – Once an agreement has been reached, we will ask one of the participants to draw up a draft agreement and when finally agreed, all participants will sign.

Post Mediation – Following up how things are a few weeks later is part of our commitment.
